Robert was not what is known as the "trigger man", and according to his testimony, at least he did not witness the murder happens. But because he was involved in a crime which led to the murder, he is automatically guilty under Rule assassinate crime. He was sentenced with his co-defendants of first degree murder, which carries an automatic sentence of life imprisonment without parole conditional (life without parole) in the state of Pennsylvania.
Therefore, at 16, Robert joined the ranks of American children sentenced to die in prison.
under life sentences without parole (JLWOP) is one of many areas of criminal justice in the United States apart from the rest of the world. No other country allows the imposition of life sentences without parole for juvenile offenders.
JLWOPsentences about 2,500 in the U.S., about 400 or more were issued in Pennsylvania, which is known in terms of the sentencing of juveniles as a "double imperative" of State: children involved in a homicide are automatically transferred to adult court and tried as adults ("adult crime, adult time") and the degree murder convictions of both first and second are punishable mandatory life without parole. In Robert's case, although the judge referred to his young age, noting that this was the least culpable of all defendants, no place in any part of the process for the exercise of judicial discretion. According to Marc Mauer, executive director of the Sentencing Project, which has just published a comprehensive study on the lives of juvenile lifers (pdf):
"When you impose mandatory sentences on major categories of offenders, which will inevitably attract people into these general categories, which does not belong."

More than 100 years, the juvenile justice system was created in the United States to prevent children from being trapped in a network of adults. The court recognized that the adolescent brain has not fully matured (PDF), leaving adolescents less risk averse, less able to weigh the consequences and possibly less guilty. This separate system of justice was more or less dismantled, with devastating consequences.
